巴西海关单证新规定

 Notice about SISCOMEX Carga

 

 

We would like to inform you that Brazilian Customs has implemented a new system called Siscomex Carga with the aim to enhance control of cargo inbound, outbound and in transit through Brazil which will speed up the Customs clearance, both deep sea and cabotage.

 

As from March 31st, 2008 Siscomex Carga will require complete information regarding:

 

  • All cargo loaded at a foreign port, to be discharged in Brazil for a final destination in Brazil;
  • All cargo loaded at a foreign port, to be discharged in Brazil for a final destination (multimodal haulage) in Argentina, Paraguay or Uruguay;
  • All cargo loaded at a foreign port, to be transshipped in a Brazilian port for a final destination in Brazil;
  • All cargo loaded at a foreign port, to be transshipped in a Brazilian port for a final destination at another foreign port;
  • All cargo in transit through Brazil, i.e. cargo loaded at a foreign port, to be discharged at another foreign port (FROB – freight on board).
  • All cargo loaded in a Brazilian Port, to be discharged either in Brazil (cabotage) or at a foreign port; and
  • All empty equipment either loaded, in transit or to be discharged in Brazil.

 

For all cargo shipped to or via Brazil CSCL agents abroad are required to complete BL data transmission to TS system no later than 05 (five) working days before vessel’s arrival at the first Brazilian Port of call, including following mandatory information:

 

1)      Name of company, complete address and CNPJ Nº (tax ID No) of Consignee and Notify parties is required;  it means that no private person can be notify or consignee (except personal effects). . In case of  Personal Effects the Passport number for all and CPF, for Brazilian citizens only - (individual taxpayers ID) -  

 

 

2)      Volume (in cubic meters – m3) of cargo and type of packaging (pallets, boxes, big bags, etc);

3)      Gross weight of cargo for each container (excluding equipment tare weight);

4)      harmonized system code of each type of commodity shipped, at least the first 4 (four) digits;

5)      description of cargo must be complete and specific, avoiding general descriptions that do not allow proper identification (such as general cargo, dry cargo, chemicals, perishable items, etc);

6)      In case of vehicles or motorcycle the numbers of chassis and motor is required.

7)      For all import Bs/L manifested with consignee “To Order” the CSCL agent has to send to Siscomex Carga the name of final cargo receiver, including complete address & CNPJ Number. It must be done preferably at least 72 hours prior to vessel’s arrival at discharge port. All import BL consigned “To Order” is subject to a special clearance analysis from Brazilian Customs, which may delay cargo release.

 

Notes:

 

Ø      Failure to fulfill mandatory requirements as per above will put cargo “on hold” and CSCL may face heavy fines (from R$ 5000,00, equals to USD 2.900,00, up to ten times the amount ocean freight + charges manifested) plus storage, demurrage and reefer cargo care. Any fines received consequential of failure to provide full data required will be debited to agency at POL.

 

Ø      Brazilian customers have been informed about Siscomex Carga implementation of all these requirements and have been requested to advise their suppliers (Shippers) to send all requested information on their Shipping Instructions to be sent to your attention.

 

Ø      Cargoes coming from certain ports abroad (mainly Argentina and Uruguay FROB) which have shorter transit times to Brazil, will have a smaller deadline for the CSCL to send the respective BL data electronically to Siscomex Carga, to be determined by the local customs office.. As soon as we have this information we will revert.

 

With the implementation of Siscomex Carga there are two possible ways to send a BL Correction Request to a Brazilian agent:

 

a) Correction e-mail (and via OIP) can be sent until 72 (seventy-two) working hours before vessel’s arrival at the Brazilian discharging port. In these cases a new set of Original BL  must be reissued by origin port and exchanged by the previous set of Original BL already delivered to Shippers; or

 

b) Any correction send after 72 (seventy-two) working hours before vessel’s arrival at the discharge port must be sent via our official Correction Letter form, which will be delivered to Brazilian Customs after vessel’s berthing.  

 

 Note - Brazilian Customs only accepts Correction Letters to a maximum period of 30 running days after vessel’s arrival at discharge port, as long as there is no Customs entry by consignee.

Correction Letter changing consignee name IS DOES NOT accept by Brazilian Customs House.
